From 1 April 2014 the fees to be paid to the EPO will increase. Notably, the fee for appeal will climb by no less than 50% from EUR 1,240.00 to EUR 1,860.00. Therefore, we recommend filing any envisaged appeals before the fee increase will come into effect.
With the removal of the time constraints on filing divisional applications (see our Client Information of November 2013) the EPO will – for the first time – charge an additional fee for divisional applications based on an earlier divisional application. The additional fee will be EUR 210.00 for a divisional application of second generation, EUR 420.00 for a divisional application of third generation, EUR 630.00 for a divisional application of fourth generation and EUR 840.00 for a divisional application of fifth and any subsequent generation. Still, no additional fee will be charged for a divisional application of first generation.
